NEXORA – TERMS & CONDITIONS OF SERVICE
These Terms & Conditions form part of every quotation, invoice, and agreement issued by NEXORA and shall govern all services provided unless otherwise agreed in writing.
1. Scope of Services
NEXORA shall provide the production services outlined in the approved quotation or invoice. Any additional equipment, manpower, services, or changes requested after approval may attract additional charges.
2. Booking & Confirmation
A project is only considered confirmed upon:
•Written acceptance of the quotation or invoice.
•Payment of the required deposit.
•Receipt of any requested documentation from the client.
NEXORA reserves the right to release unconfirmed dates to other clients without prior notice.
3. Payment Terms
•A minimum of 70% deposit is required to confirm all bookings.
•The remaining 30% balance must be paid before the commencement of the event, unless otherwise agreed in writing.
•NEXORA reserves the right to suspend, delay, or withhold services where payment obligations have not been fulfilled.
4. Additional Charges
The client shall be responsible for additional costs arising from:
•Changes to the agreed scope of work.
•Extension of event hours beyond the agreed schedule.
•Additional equipment or personnel requested on-site.
•Waiting time caused by delays not attributable to NEXORA.
•Additional setup or dismantling requirements outside the agreed schedule.
All additional services shall be invoiced separately.
5. Event Delays & Overtime
The agreed production schedule shall be strictly observed.
Any extension beyond the agreed event duration will attract overtime charges based on NEXORA’s prevailing rates.
6. Client Responsibilities
The client shall provide:
•Safe and unrestricted access to the venue.
•Reliable electrical power where applicable.
•Adequate security for all NEXORA personnel and equipment.
•Necessary permits, licenses, and approvals required for the event.
Any delay resulting from the client’s inability to meet these responsibilities shall not be the responsibility of NEXORA.
7. Equipment Responsibility
All equipment supplied by NEXORA remains its sole property at all times.
The client shall be liable for the repair or replacement cost of any equipment that is:
•Lost
•Stolen
•Damaged
•Misused
•Destroyed
while under the client’s care, custody, or at the event venue.
8. Force Majeure
NEXORA shall not be held liable for delays, interruptions, or inability to perform services resulting from circumstances beyond its reasonable control, including but not limited to:
•Extreme weather
•Government restrictions
•Civil unrest
•Fire
•Flood
•Power grid failures
•Venue restrictions
9. Cancellation Policy
If the client cancels a confirmed booking:
•Deposits already paid are non-refundable.
•Cancellations made close to the event date may attract additional charges to cover resources already committed.
•Any expenses already incurred by NEXORA on behalf of the client shall be payable in full.
10. Limitation of Liability
While NEXORA will exercise the highest professional standards in delivering its services, liability shall be limited to the total amount paid by the client for the affected service.
NEXORA shall not be liable for indirect, incidental, or consequential losses including loss of business, revenue, or reputation.
11. Photography & Marketing
Unless otherwise agreed in writing, NEXORA reserves the right to photograph, film, or record portions of the production for portfolio, marketing, promotional, training, and social media purposes.
12. Health & Safety
No person other than authorized NEXORA personnel may operate, move, adjust, or interfere with NEXORA equipment during the event.
13. Acceptance
Payment of any invoice, acceptance of a quotation, issuance of a purchase order, or confirmation of a booking constitutes acceptance of these Terms & Conditions.
